Terms of Service

Pickup Finder (“we,” “us,” or the “service”) is operated by Otto and Teo Dierig. By creating an account, signing in, or otherwise using the service, you agree to these Terms of Service. If you don’t agree, please don’t use the service.

Pickup Finder is a listing and coordination tool. It lets people post pickup soccer games, see who has RSVP’d, and find games near them. That is the entire scope of what we do.

We do not organize, host, supervise, staff, referee, coach, or insure any game listed on the service. We do not own, lease, control, maintain, or inspect any field, court, park, or other location. We do not provide equipment, medical personnel, or first aid. We do not verify, vet, screen, or run background checks on any user, and we do not confirm that any information a user posts is accurate.

Games are arranged directly between users. Any agreement to play, and everything that happens before, during, and after a game, is between the people involved and does not involve us.

You must be at least 13 years old to use Pickup Finder. If you are under 18, you may use the service only with the knowledge and consent of a parent or legal guardian, who agrees to be bound by these terms on your behalf. If you are a parent or guardian and believe your child is using the service without your consent, contact us at teodierig@gmail.com and we will remove the account.

Accounts are created with a phone number. When you sign in, we send a one-time code to that number by SMS. By providing your number and continuing, you consent to receive these messages. Message and data rates may apply, and message frequency depends on how often you sign in.

These are transactional sign-in messages only — we do not send marketing texts. You can reply STOP to opt out or HELP for help. Opting out means you will no longer be able to receive sign-in codes. See our Privacy Policy for how we handle your number.

You are responsible for keeping access to your phone number secure and for activity that happens under your account.

Soccer is a physical contact activity that carries an inherent risk of injury, including serious injury, permanent disability, and death. These risks cannot be eliminated. They include, but are not limited to, contact with other players, falls, collisions, overexertion, weather and heat, poor or unsafe field conditions, defective or missing equipment, inadequate or absent supervision, the absence of medical personnel, and the actions or inactions of other participants and bystanders.

You understand these risks and voluntarily choose to participate. You are solely responsible for deciding whether a game, a field, or a group of people is safe and appropriate for you, and for determining whether you are physically fit to play. Risks also include travel to and from any game.

To the fullest extent permitted by law, you release, waive, and agree not to sue Pickup Finder, its operators, and anyone acting on their behalf from any and all claims, demands, damages, injuries, losses, costs, or expenses of any kind arising out of or related to:

(a) any game you find, join, organize, or attend through the service; (b) the acts or omissions of any other user or third party, whether before, during, or after a game; (c) the condition, safety, availability, or permitted use of any field or venue; (d) travel to or from any game; and (e) any dispute between you and another user.

This release applies whether the claim arises from ordinary negligence or otherwise, to the maximum extent the law allows. Some jurisdictions do not permit the exclusion of certain liability, so parts of this section may not apply to you.

Provide accurate information about yourself and about any game you post. Treat other users with respect. Do not harass, threaten, stalk, discriminate against, or endanger anyone. Do not use the service for anything illegal, or to post content that is abusive, deceptive, or infringing.

Do not scrape the service, attempt to access accounts or data that aren’t yours, or interfere with its operation. We may suspend or remove any account or listing at any time, for any reason.

Many public fields require a permit, a reservation, or adherence to posted park rules, and availability changes without notice. If you post or attend a game, it is your responsibility to confirm that the group is allowed to use that space at that time.

A field appearing on Pickup Finder is not permission to use it, an endorsement of it, or any representation that it is available, safe, or lawful for your use.

The service is provided “as is” and “as available,” without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that game listings are accurate or current, that a game will actually take place, that anyone who RSVP’d will show up, that headcounts or waitlists are correct, that the service will be uninterrupted or error-free, or that any defect will be fixed. Pickup Finder is a free service offered as a personal project, and may change or shut down at any time.

To the fullest extent permitted by law, Pickup Finder and its operators will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, lost data, personal injury, or property damage arising out of or related to your use of the service.

Our total aggregate liability for all claims relating to the service will not exceed one hundred U.S. dollars ($100). You acknowledge that the service is provided free of charge and that these limits are a reasonable allocation of risk.

You agree to indemnify and hold harmless Pickup Finder and its operators from any claim, liability, damage, loss, or expense (including reasonable legal fees) brought by a third party and arising out of your use of the service, your participation in or organization of any game, your violation of these terms, or your violation of any law or the rights of another person.

You may stop using the service at any time and can request deletion of your account by emailing teodierig@gmail.com. We may suspend, restrict, or terminate access to the service, in whole or in part, at any time and without notice. Sections 5, 6, 9, 10, 11, and 13 survive termination.

These terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Hudson County, New Jersey, and you consent to their jurisdiction.

We may update these terms from time to time. When we do, we’ll revise the “last updated” date at the top of this page. Continuing to use the service after a change means you accept the revised terms.
